SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE CONTIGUOUS UNITED STATES, INCLUDING D.C. Overview:The TopCoat Mania (the “Promotion”), sponsored by TopCoat Products LLC. ("TopCoat" or “Sponsor”), and administered by Mighty Loud Enterprises ("Mighty Loud" or "Administrator") consists of a sweepstakes drawings at random for one (1) winner to receive certain prizes as more fully detailed herein (together, the "Prizes" and individually, a "Prize").  Participants will be required to comply with these rules (the “Official Rules”) in order to win and receive the Prizes.

Entry Periods:The Sweepstakes entry period begins July 29, 2024 at 8:00 a.m. Eastern Time and ends on June 20, 2025 at 11:59 p.m. Eastern Time (the “Entry Period”). All entries must be submitted and received by Sponsor during the respective Entry Period to be eligible to participate and receive that Prize.  The Sponsor's clock shall be the official timekeeper for the Promotion.

Eligibility:The Promotion is open only to legal residents of the contiguous United States, including the District of Columbia and excluding Alaska and Hawaii, who are at least twenty-one (21) years old at the time of entry. Employees of Sponsor, Mighty Loud Enterprises, TopCoat Products LLC and its dealers and retailers, affiliates, sales representatives, distributors, and promotional and other vendor agencies, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors involved in the promotion, and the immediate family (parent, spouse, including common law spouse, sibling, child, grandparent, grandchild, regardless of where they reside) and household members of all such employees, are not eligible to enter the Promotion. The Promotion is subject to all applicable federal, state, territorial and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules. Sponsor’s decisions are final and binding in all matters related to the Promotion. Winning a Prize is contingent upon fulfilling all requirements set forth herein. 

How to Enter:

You can enter the Promotion by visiting the Topcoatmania.com and following the instructions to complete and submit a registration form. The form will request certain information, including without limitation your name, address, date of birth, phone number, and email address. You will receive two (2) entries upon registration. You can thereafter access Topcoatmania.com in order to submit additional entries up to the stated limit.

Events:

During the Entry Period, Sponsor will attend various events where it will advertise the Promotion and provide a QR Code for access to a registration form. Click here Topcoatmania.com for a complete list of participating events. You will receive two (2) entries for initial entry through the registration form. You can thereafter access the Event Page in order to submit additional entries up to the stated limit.

Notice of Collecting Geolocation Data:  

How Geolocation Data is Collected: At the time of initial entry, you may be asked to enable location services on your device in order to collect your precise geolocation.

How Geolocation Data is Used: If you enable location services, your precise geolocation data will be collected to verify your location at the time of entry.  

Neither Sponsor nor Administrator will sell or share your precise geolocation data with anyone, at any time, for any reason.

Your Choices: You are not required to enable location services or to allow collection of your precise geolocation in order to participate in the Promotion.  Your precise geolocation data is deleted and will not be retained after the initial time of entry.  At any time, you may choose to ask us to tell you what data we have about you, to correct inaccurate data, to delete your personal information that we no longer need, and to confirm that we do not sell or share your personal information, including precise geolocation, with anyone.  For more information on how Sponsor collects, uses, and shares your personal information, please refer to TopCoat’s privacy policy, available at [insert link]

You can alternatively enter by sending emails during the Entry Period with your name, address, date of birth, email address and phone number to: contestentry@mightyloud.com. You will receive two (2) Sweepstakes entries upon registration.  You can thereafter send emails with the same information to submit additional entries up to the stated limit.

Neither Sponsor nor Administrator assumes responsibility for lost, incomplete, or incorrect entries. All entries must be submitted and received by Sponsor by 11:59 pm Eastern Time on June 20, 2025 to be eligible for the drawing. All entries become the property of the Sponsor and will not be returned or acknowledged. 

Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of Sweepstakes entries (as outlined below) by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being an authorized account holder.

Limit: 

Limit maximum of hundred (100) entries total per person and per email address throughout the Promotion, regardless of method of entry. Any and all additional entries submitted over the stated limits as defined herein will be considered void. Only one person per email address. 

You will receive two (2) Sweepstakes entries during the Entry Period for registering for the Sweepstakes. There are other opportunities during the Entry Period to submit more entries. No entrant may submit more than hundred (100) entries total regardless of method of entry. All entrants have the opportunity to submit a total hundred (100) entries. 

Odds of Winning and Prizes:

Odds: Odds of winning depend on the number of eligible entries received from all methods of entry. Only one person can win. 

Prizes:The Promotion will consist of the following prize:

All expenses and incidental travel costs not expressly stated in the Prize descriptions above, including but not limited to, airfare, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges, or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of the Prize winner. Prize winner must comply with any applicable requirements, such as presentation of a major credit card. Prize winner is solely responsible for any and all guests.

All taxes, fees, costs, or other expenses or liabilities associated with the Prizes are the responsibility solely of the winner.Winner will be provided requirements for use of Prizes when notified of win. Winner must be able to comply with all requirements in order to win. Prizes are non-transferable, must be accepted as awarded and do not have any cash equivalent. Sponsor reserves the right to substitute a Prize for one of equal or greater value if the designated Prize should become unavailable for any reason. 

How To Win:  Winner will be selected at random. Within approximately 24 hours after the close of the Entry Period, Sponsor will conduct one (1) random draw and randomly select the potential winner.

Sponsor and Administrator's decisions as to the administration and operation of the Sweepstakes and the entirety of the Promotion, including without limitation the selection of the winner, are final and binding in all matters related to the Sweepstakes and Promotion.

The potential winner will be notified by email, call, or text message, at the discretion of the Sponsor, to confirm eligibility to award the Prizes. The winner will be required to sign and return a Declaration of Compliance, Liability Waiver, and, where not prohibited, sign and return a Publicity Release (the "Requirements"), all of which must be received in the manner set forth upon notification within forty-eight (48) hours of the date notice or attempted notice is sent, in order for a potential winner to claim the Prizes.  By accepting the Prizes, the winner acknowledges responsibility for paying all additional costs associated with taxes, costs, and any other related fees.

If any potential winner is determined ineligible or otherwise disqualified, at the discretion of Sponsor (and as further described herein), an alternate drawing from among all eligible entries received will be conducted for the Prizes. A Sponsor representative will provide to the verified and confirmed Prize winner the respective reservation confirmation numbers and all other pertinent information needed for awarding of the Prizes. Winner will have the option of receiving the gift card portion of the Prize by certified mail/FedEx or via a digital transfer at the discretion of Sponsor.  

Any potential winner who cannot be contacted, or who fails to complete the Requirements or to provide any other requested information within the time period designated, shall be deemed to have refused and forfeited the Prizes and thereby disqualified and ineligible. Receiving the Prizes is contingent upon compliance with these Official Rules. In the event that a potential winner is disqualified for any reason, declines or forfeits the Prizes, Sponsor will  conduct a random draw to select a new winner from among all remaining eligible entries. Sponsor will conduct a minimum of three (3) alternate draws (if necessary) as described above, but will endeavor, time permitting, to award all Prizes, after which the Prizes may remain un-awarded.

Additional Requirements and Terms:  

Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. There is no cash equivalent or other substitution for the Prizes. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Prizes are awarded “as-is” without any warranty of any kind, either express or implied, and to the fullest extent permitted by applicable law, none of Sponsor, Administrator, or their respective affiliates or agents have made or will be responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to such Prizes, including without limitation, the camper's quality, mechanical condition, merchantability, or fitness for a particular purpose. To the fullest extent permitted by applicable law, none of Sponsor, Administrator, or their respective affiliates or agents have made or will be responsible in any manner for any negligence, wrongdoing, warranties, representations, liabilities, or guarantees, express or implied, in fact or law, relating to the Prizes. 

Release:  By receipt of any Prize, and to the fullest extent permitted by applicable law, winners agree to release and hold harmless Sponsor and Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any Prize herein referenced.

Publicity:  Except where prohibited, participation in the Promotion constitutes each winner’s consent to Sponsor’s and Administrator's and their respective agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. 

General Conditions:  Sponsor reserves the right to cancel, suspend and/or modify the Promotion and Sweepstakes, or any part thereof if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of any of the foregoing, or any event or cause beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies, wide spread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Promotion and the Sweepstakes, including but not limited to fulfillment of the Prize(s), as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance and may modify the Prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion and the Sweepstakes, or to be acting in violation of the Official Rules of this or any other TopCoat promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion and Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  No substitution of any prize is offered, no transfer of any prize to a third party is permitted and non-cash prizes may not be redeemed for cash. Any portion of a prize not accepted by the winner will be forfeited. 

Void wherever prohibited or restricted by law. All income, federal, state, provincial, territorial and local laws and regulations apply. Prize recipient will be solely responsible for paying all applicable and local taxes on Prizes, and if applicable, winner may receive an IRS Form 1099 for the retail value of any Prizes.

Limitations of Liability:The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion and Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion and Sweepstakes; (4) technical or human error which may occur in the administration of the Promotion and Sweepstakes, or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion and Sweepstakes, or receipt or use or misuse of any Prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of Prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of Prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of Prizes in accordance with these Official Rules. Administrator and each of its respective affiliates, subsidiaries, shareholders, representatives, officers, directors, agents, and employees, shall have no liability or responsibility for any claim arising in connection with the use or award of the Prizes.

Disputes, Choice of Venue and Law:Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes and Promotion or any Prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court sitting in Cobb County, Georgia [confirm this is Sponsor's preference]; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes and Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes and Promotion, shall be governed by, and construed in accordance with, the laws of the State of Georgia [confirm this] without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia [confirm this] or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia [confirm]. All entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding. Sponsor reserves the right in its sole discretion to disqualify any and all individuals (and their Sweepstakes entries) who tamper with the entry process.

All such personal information collected during this Promotion is for the benefit of Sponsor and accordingly subject to Sponsor's privacy policy, accessible at [insert link to TopCoat privacy policy]. Entrants may request access and correction to their personal information, and withdraw their consent to the Sponsor’s use of their personal information (subject to legal or contractual restrictions and reasonable notice), by contacting the Sponsor at [insert email], using subject line “Personal Information Request.” The Sponsor will store personal information about entrants in the United States and, as a result, such information may be accessible to law enforcement and national security authorities of that jurisdiction under laws applicable there. By entering into this Promotion, each entrant expressly consents to the Sponsor and Administrator, and their agents and/or representatives, collecting, storing, sharing and using the personal information submitted at the time of entry (including, without limitation, name, address, etc.) for the purpose of administering the Promotion, unless the entrant agrees otherwise. You may be offered the opportunity to receive additional communications from Sponsor or Administrator or about their products, and upcoming contests and promotions.

By participating in this Promotion and submitting an entry, you agree to receive by mail, email, phone call, or text message communications from the Sponsor and Administrator in the administration of this Sweepstakes and Promotion, as well as further communications from Sponsor. If at any point you do not wish to receive such communications, including at time of entry, you may choose to opt out at any time. No communication unrelated to the contest, commercial or otherwise, will be sent to the entrant by the Sponsor, unless the entrant has otherwise authorized the Sponsor to do so or as permitted by applicable law. If you choose to opt out of communications from Administrator or Sponsor during the pendency of this Promotion, you may forfeit your opportunity to win.
